    Get rights taken from my sons biological father
    What do I need to do to get rights taken away from my sons biological father, whom has not even made an effort to c him for about 9 months now?

    Can you prove that he is a danger to the child? If not then forget about it.

    He doesn't have anything to do with him unless I'm around. He only wants him if he can have me and that's not going to happen! He doesn't try to c him or call about him or anything.

    So he doesn't want to exercise his rights that's his choice. Have you gone to court for child support? If not then you need to file in court for support if he didn't sign the because then the judge will first order a DNA test then will order support and visitation. He will have to pay the support the visitation is up to him. But bottom line you aren't going to have his rights terminated.

    It doesn't matter if he is in the child's life or not. My daughter's father hasn't seen my daughter in about 3 years and has never paid me child support. The only way that I can do anything is to file for abandonment since we haven't had contact in a few years. His rights still will not be revoked though. The bio father can sign over his rights to another man if you were to get married, but he would have to do it voluntary. He can not just go and sign his rights away though without a father figure stepping up to claim the child. The child can't go fatherless. That is what the courts have told me. I proved that my daughter's father was unfit when I got a restraining order on him and told the judge about his drug use and his recent convictions and he still has his rights, he just can't see her until he completes some programs. I have been going round and round to try to change my daughter's last name and everything. Good luck with everything.
