    Bankruptcy/death of spouse
    What happens to a bankruptcy charge after the spouse is deceased? Will the living spouse be responsible for the balance of the bankruptcy?

    First I am very sorry for your loss

    I am sorry first what "balance" of the bankrutpcy, if you are in a chapter 13 payment plan, yes the balance may still be due, but since income and other factors have changed, you may need to have it changed and a new payment plan figured on the new levels of income. Since a chapter 13 would be the only plan where you have a balance to owe.

    Or you may need to change it to a chapter 7 if payment is not possible according to the plan after consulting with your attorney.

    First take time and breath and don't do any major decissions for a little bit. Getting over the grief of a death is first.
    Next sit down with our attorney that was doing the bankrutpcy and find out what the status is and how the death effects the issue.
