    Is My Signature required to Renew a lease in AZ?
    Hello~

    My husband and I are desperately seeking an answer to this question ASAP. Any assistance would be greatly appreciated!

    We live in AZ and signed a year's lease agreement, which ended August, '07. My husband signed a paper indicating that we would extend the lease and provide 90 days notice, should we decide to leave (I had no knowledge of fact until two weeks ago) :eek:

    In our state, if a lease is not renewed after the termination date has past, then you are automatically reinstated on a "month-to-month" basis.

    But I'm wondering if the paper that my husband signed without my knowledge or consent will bind us to this agreement?

    Yes, since he had the right ( unless you were separated or divorced at that time) to agree to the lease, so his agreement to extend the lease should be binding.

    Why did he do this without telling you ?
    And of course assuming you are both still there, are you wanting him to break his agreement with them?

    Thank you so much for your quick response! Of course, there's always more to the story... but I assumed that we would be held liable.

    Why did he do this without telling me? I have no clue!! (nor does he, for that matter)

    The reason for our wanting to break the agreement is threefold:

    1. The home we're living in needs to have MAJOR construction done to it, due to negligence of the builder. When it was built, four years ago, I guess they didn't build on the "right" type of soil. Subsequently, the house is sinking! There has been MAJOR construction in our once peaceful development, and we DID NOT sign up for this.
    2. Our landlord has been rather neglectful of her duties involving keeping up with maintenance of landscaping. We are renting in a very exclusive area and pay big money each month. It is quite ironic that she would have my husband sign the renewal and then within two months of his signature, all of this stuff happens?!
    3. Proximity to anything and everything is not why we chose to live here. We specifically chose to move here, for the peace and quiet. Needless to say, it is quite frustrating to awake each morning for the past four months to bull-dozers, dump trucks, sand-blasters, ditch-layers, beeps, honks, etc. This is honestly, our primary reason for wanting to move

    You may want to see if there is any "illegal" condition to the home, something unsafe, perhaps have the building and zonning inspectors out to see if there are any grounds for you to file a law suit against the landlord.
