    Getting married to an immigrant
    How do I get married to an illegal immigrant from mexico that don't have his birth certificate

    Illegal immigrant aside - he need some proof of his birth and age. Sometimes a Baptismal Certificate will suffice.

    He will have to go back to mexico and come into this country legally. Otherwise there may be issues with obtaining a licence.

    Tried to give you a greenie but...

    In NYS no one checks for citizenship when you apply for a marriage license. It's caused a lot of problems with "illegals" marrying citizens and then applying for citizenship based on the American spouse.

    Whoa I had no idea. They already make us normal citizens jump through hoops for homeland security I wasn't aware you didn't have to have papers. The person could say their name is El Cabong and run off with everything another person has without a trace.

    I guess Im old fashioned and believe marriage is a special thing not to be taken lightly.

    Well, you do have to show a Birth Certificate (or Baptismal Certificate) but I've always wondered (and I'm not joking) just how the Town/City Clerk knows that you are, in fact, that person. I wasn't asked to show any other ID - no drivers license, nothing.

    Maybe it's different in other parts of the US.

    (I don't know if it's old fashioned to think marriage is a special thing. I do think, though, that "crap" can happen and the best intended people can end up divorced.)

    He must contact his family in Mexico to obtain a certified copy of his birth certificate or have original copy mailed to him, if he already had one at home. To do so, he may need to contact the embassy to get power of attorney.

    Getting married in US, for foreigners, you need 2 types of ID.

    Better take care of the birth certificate issue ASAP, because he needs one at every step in immigration procedures.

    Again this also depends on what state you are in I know in Indiana I had to have my license, birth cirtificate, and proof of vaccinations, and my for my husband and I to get our marriage license five years ago. And we were both born and raised in Indiana lol!

    First you ask the clerk at the court exactly what ID he needs. If he has to have a birth certificate, of course he has one, it may be in Mexico but he has one, and will need to get a copy sent to him,

    There are even firms that help you get one

    Proof of vaccinations? The Clerk didn't care who I was, let alone if I'd been vaccinated against anything. Too funny!

    In case the marriage is between a US citizen and an alien, requirements are different. The alien has to provide 2 forms of ID, one must be photo ID which usually means passport.

    Birth certificate is essential in immigration process as he will need it to apply for adjustment of status, to remove conditions on the green card, etc.

    He will eventually have to return to his home country and come back the proper way if he is illegal, true, it means u got to sponsor him from your side, and u cannot claim any benefits, u got to be able to support him and u.u don't need the birth certificate to get married.
