    Vacate a Judgement
    We were granted a judgement against someone who owed the company money. Now it has been years later and the person the judgement attached to is the same name but the wrong person. I called the county administrator for the county the judgement was placed and she said I need to do a vacate on the judgement. How do I go about this?

    Are you talking Small Claims? The Clerk should have the form - at least they do in NYS.

    I don't know why the Judgment would have to be vacated - if it's a legal, true Judgment and just attached to the wrong person can't you remove it from that name and attach it to the other person with the same name? If you vacate it it's gone forever and I don't know the time frame but you may have lost the opportunity to move against the right person.
