    Does my son need a new public defender
    My son was arrested for robbery 1st. He is innocent. A car was stolen by 2 of his friends, he was not there at the time the robbery occurred. His friends picked him up later and gave him a ride, he thought they borrowed the car and as soon as he found out it was stolen he got out and went home. The next morning it was on the news that they had a 3 county chase with the other guys and showed it on TV them getting arrested. 2 weeks later my son was arrested with the same charge. The only thing they have against him is a police report that a witness said he was there. So he got indited for it. Since then, the witness says the police are lying. She knows my son was not there and she even went to his lawyers office and told him that he was not there. And also wrote a statement and had it notarized at the courthouse. So today he was supposed to go to the pretrial conference.
    He was escorted to the courthouse sat for hours then took back to the jail. He never even talked to or seen his lawyer today. I might add that one of the other guys is in the same pod in jail with my son. He also had court today and got his motion of discovery. My son didn't get anything not even an explanation. He has tried to call his lawyer and so have I.
    So what does he need to do? Please help...

    It is hard to say what his lawyer is up to. I have seen some that will not discuss anything with the client or parents but go in well prepared.
    I have seen others that were clueless and useless.

    More than likely your son can be charged with something simply for being in the car at all, at any point. I have seen Judges say that not knowing the car was stolen or not legal in whatever way is no excuse because you are to ask to see registration, license, insurance, etc before you set foot in any body's car.

    Hopefully the Judge will see he was not 'involved' directly and give him a minimal sentence and/or fine. The time he is in there waiting should be credited toward whatever the Judge rules.
