    Public defender
    If you are in federal jail waiting for sentecing with one month to go before sentencing how do you go about getting rid of your public defender? Who's not there for you and won't help you with an appeal and tell you to chalk the situation up and take your punishment like a man. Nor ever gave you a 3500 material (new york)

    You make a motion to the court to have them replaced. You may also talk to the PD office and see if they will re-assign. But a Public Defender is there to be sure your rights are not violated.

    Hello ak:

    You fire him just like you do anybody who works for you. Send him a letter telling him exactly what you told us. Send a copy to the judge and to the prosecutor.

    When request to dismiss public defender not accepted by pub. def. office and when new one is not assigned, what motions have to be filed with what grounds? State please.
