The right to see a deceased person's will
My second cousin recently left some family member small financial bequests in her will. She also left jewellery to two of the female relations.

Today I phoned the lawyer dealing with this as the jewellery has never turned up. He said he didn't know how he was going to get it to us. He 'supposed' he could send it recorded delivery but couldn't do it this week as his secretary was away. His whole manner and attitude was quite appalling and I am not sure whether the law firm is at all reputable - cannot find a web site for them, although they are listed.

Clearly if I hadn't been in touch, the jewellery would probably just stay there!

It makes me wonder if they have sent the correct amounts in the financial bequests... do we have any rights to see the will? And can I complain about the lack of attention to them passing on the jewellery? She died last September and the cheques were sent out in January.

    Thank you.

What State? Not having a website does not make a firm unreputable - many are still resisting any form of advertising, some don't bother, others don't want the "free advice" calls.

Certainly you can see the Will - go the local Probate Court and they'll let you review the entire file - Will, releases, tax info, appraisals. Basically the jewelry couldn't just stay there because there has to be a final accounting and you "should" have to sign a release. Is he sending you the jewelry without a release (which in theory he would file in Probate Court)?

In my area it is not the least bit unusual for things to take this long to get settled - in fact, the checks went out very quickly in this estate. It is not unusual to wait at least 90 days to even begin in order to make certain all the decedent's bills have been received and paid by the estate.

(Have other members of the family had problems with this Attorney?)
