    1099 student resident alien
    I was doing internship last year . I was on 1099 MISC. I am a non-resident alien since been here for more than 5 years. I was registered for thesis credits last year in school and was also doing full-time internship. Am I liable for FICA (social security and medicare) taxes?

    Er...

    If you were in the US for more than five years then you are resident alien of the United States for tax purposes.

    If you were here for less than five years then you are non-resident alien.

    So which one is it?

    I am sorry . My mistake.
    I have been in the USA for more than 5 years as a student. I am a resident alien. SO the question is pertaining to my status as a resident alien and hence would like to know if I have to pay FICA taxes. I was registered for CPT during my internship and also was taking 3 thesis credits.
