    OPT Married Filling Jointly - Which Tax Form to Use?
    Hi ,

    My husband and I are both on OPT for the entire Year of 2006. Please let me know which tax form should we file? Will it be 1040 NR or 1040 NR-EZ or regular 1040? We have very little interest income. Are incomes are mainly salary , bonus, & interest free loan. And our expenses include relocation expenses. Also I live in Ohio , which return do I need to file in Ohio?

    You will BOTH file your OWN non-resident tax return, either Form 1040NR or 1040NR-EZ.

    The interest income is probably tax-exempt because you are still considered to be foreign students.

    If you had relocation expenses that you paid for out-of-pocket, then file Form 1040NR with Form 3903 to claim those moving expenses.

    For Ohio, you need to file an Ohio state tax return.

    BTW, is it REALLY 2006, or did you mean 2007?

    Sorry I meant 2007.
    So we can't file a joint return? For Tax year 2006 my husband filed his tax return and claimed me as a dependent since I was on an F2 and my husband was on F1. Is it because now I am on F1 visa for year 2007 , we can't file a joint return?

    Also next year both of us will be on H1 can we then file jointly for 2008?

    If you file as non-residents, you CANNOT file either Married Filing Jointly or Head of Household.

    You file as MARRIED or SINGLE.

    In 2008, when you file as resident aliens, you can file jointly then.
