I need to know if we can get out of a 5 year commercial lease?
Here is the situation. We were promised signage off the rd that are address is on. That didn't happen. They put it on the side rd, making it hard for people to know we are here. n

We have not got near the business we thought based on the prime location we are in. All the businesses around us are suffering as well. We are looking in to creating a petition to ask for signage for the businesses in the plaza on the main rd that are address is on.

The biggest issue is we have nothing in writing to where we were promised the signage. We just have our word verse theirs.

We really just want the sign, but we need to find out if there is a way to get out of the contract with out getting sued. We are in Douglasville, GA.

    Hello Look:

You'll need a better reason than that not to get sued. You'll have to hire a lawyer to find one, though.

Yes, since you failed to have it written into the lease, the written lease takes authority over any verbal agreement ( and most leases even say that in them) So this is not a reason to breech the lease.

Also was there zoning issues to a sign there, I know in some areas you have to get city permission for signs and often you are not allowed to put them where you want them, So if they put a sign up, why did they not put it there, have you asked.
Also have you asked if you and the other tennants perhaps can pay to have a sign put where you want it? Always a choice
