    Can a 20 year old receive his own child support?
    Hello, I am a mother of four and have been paying child support for the past 17 years. I now have a son that lives with another family. He is 20 years old and has a full time job. I would like to know if he is able to receive the child support instead of his father. Is there any case studies for NY that I could use to justify this in support court.

    What is the reason you are paying child support for a 20 year old? Is he still in school, or is it back child support that you are paying?

    I have a friend who is 25, and he receives his own child support from his father. He gets it on a child support card that he can use as a debit card. Now, I'm not sure the situation on his child support status... but I know he is NOT in school.

    Personally, I would assume if it is back child support you are paying, that it would still go to the father because he had to solely support the children while no child support was coming in. But if it is because the child is still in school, then I would think the child support could go to the child.

    Every child support case if different and has different circumstances. I would suggest contacting an attorney for a free consultation and let them tell you the laws and possibilities for child support in your area.

    Don't have an answer but usually in NYS child support ends when the son is emancipated or fully employed. Does your Order say something to the contrary?

    The other side of this is if he still lives with his father the father is assumed to be using the child support money for utilities, rent, food - the money is not the child's for his other expenses.
