    29 year old child support
    Thanks For your time,
    My best friend was arrested yesterday over back child support payment from Michigan.
    We live in Florida (So he is to be extradited back to Michigan and no bail can be set) He was never married to this woman, and can't remember any occasion this may have occurred.
    He was married at the time and was having his 1st child with his wife then. This happened in 1979 and no papers were ever served until 6 years ago while he was employed by my company. (garnised wages were paid then but the company was closed in 2001, no payments have been sent since) The child support in question was filed originally to a supposed address that he had never lived in Michigan.

    The origanal Mother was an alcoholic and past away 3 years after giving birth of an alcoholic over-dose.The child in question ended up in foster care. The foster care family supposidly tried to win the child support but the child in question took them to court to fight for the money for herself and won.

    Michigan has since past a law to support DNA testing for proof of relationship. We need help understanding what the process will be and where we should obtain a Lawyer. HELP!

    You can find an atty locally that has a Michigan affiliate or work directly with a Michigan attorney.

    There has ALWAYS been ways to determine paternity besides DNA testing. So I don't understand why your friend didn't request a paternity test when he was first informed about the child.

    But that's water under the bridge. I have little sympathy for your friend since he could have taken care of this long ago and should never have let it come to this point. However, the first step is to confirm paternity. Once that has been done, you need to determine exactly what is owed. Since the child is now an adult, the only thing he should owe is reimbursement of any public assistance that was paid out for care of the child.

    He should also be pointing out (if he is the father) that he was never informed about it until 6 years ago. That, had he been informed, he would have taken care of the child.
