    Sad immigrant
    Well... my question could be a lil' bit longer so bear with me for a moment...
    I came to US about 6 years back as a dependent but after 1 and half yrs my so called husband left me here and took the marriage certificate with him He went back home leavin' just a letter behind him because his folks wanted him to get married to someone else since my marriage was an intercast.My marriage to him was not known to anyone except for us.( he said we were going to tell the parents when the right time comes up... which never did! )I almost had 3 yrs visa back then but I didn't know a thing about immigration .I always thought he was going to come back sooner or later but all in vain and that's how I became an illegal immigrant.Now He's married to someone else back home and also have a child but as per me I don't have a legal status and I haven't been able to go back home due to various reasons .I have no contacts with him at all.I found out about his marriage and child through a fren.He emails her sometimes and when I tried to email him he doesn't reply any of my mails.All I had was a marriage certificate but he took it with him .
    Now my actual question is How can get my legal status back?What should I do? What kind of case should I file? And most importantly if I want to get married again how should I do without even getting my ex husband in picture because I know he wants no part in this at all.Someone told me that after separating for 3 yrs no divorce is necessary.Is it true? Can I get a legal status by any means?? I have no idea about where to go and whom to talk to... I'm completely lost... Could u help me by answering my questions??

    No, you are always married, until you get a divorce. So if there was no divorce you are still married to him, in 20 years you would still be married to him.

    If he remarried, ( what county ) if in the US, that marriage is not valid, since he would already be married to you.

    What nation did you get married in? If in the US, you can get a copy of your marriage licese form the court house you were married in.

    I would go get a immigration attorney, they can help you work all of this out.
