I'm married husband and I are separating.. We have a 2 year lease on this house that we are renting in Ohio.. I plan on moving out in March.. Would I be able to apply at another rental place?. and would the realator hold myself and spouse to remaining rent? By the time we move out we would have a 11 months left until our 2 year lease is up. I have been in a horriable marriage and need out.

Hello kids:

Your landlord can hold EITHER of you to the entire lease. He DOES have to rent it as soon as he can to save you money, but it's still going to cost a bunch. IF you're evicted, a lot of landlords won't rent to you anymore. I don't blame them.

Can your husband afford the place on his own? If not, does he plan on getting a roommate? Or does he plan on leaving as well?

If he can afford the place on his own, talk to your landlord and see if they will remove YOU and leave the place in HIS name. If he plans on getting a roommate, talk to your landlord and see if they will remove YOU and leave the place in HIS name and the NEW roommate. If he wants to leave as well, ask your landlord if they are willing to allow you to break the lease and what the penalties are. Some landlords will accept a penalty fee, others will allow you to move out but make you pay rent until the place is rented again or the lease ends, which ever is first.

You and your husband are jointly responsible for the lease. This means the landlord can go after both of you for the balance of the lease or at least until he can re rent it. It would make sense for one of you to stay in the house and pay the rent until the lease is up or you can sublet or find someone else to take over the lease.

Thanks for the information.. I did talk to the landlord and he said the same as as everyone said.. find room mate, rent it myself, etc.. but know the rent is to high for one of us to live there alone.. well I guess we both will have to deal with each other.. for now that means another year.. it's a 2 year lease. I know he said I could get a lawyer but not going to too much $$.

Well lets look at how bad can this get. Sounds like you guys are heading to divorce so just do that if you can't stay together. The judge may have a better solution than us. On the other hand, if you move out and quite paying your ex will have to pay the LL. The ex can the decide if he is going to sue you for the rent, by then you'll probably be in divorce anyway.
