    Is my disability income subject to alimony?
    I'm 54 (soon to be 55) and my wife and I are divorcing after 34 years of marriage. She has told our children that she is going to "take me to the cleaners". I get 2059 from social security disability and 3300 from Prudential disability (insurance I bought and paid for with after tax dollars). Can she get alimony from my disability income? She has worked for the last 30yrs.

    I hope so, All divorce is someone's fault usually both and I think she /he deserves 50% if they have put up with each other that long. I will tell you this

    I am female, been married to a mechanic for 32 yrs. I am 48 he is 49 I was filing for a divorce last year and it was at its last stages when he had a heart attack and ignored the signs and killed his heart all but 20 %. I canceled the divorce because I felt sorry for him.. His mother hates everyone. He has 2 kids with me and he has bought their affections over the years and they didn't come so it was me. He was on the respirator 4 days and came off with a difibulator, which my work insurance paid for, We have spent 408.000 dollars thus far and my insurace paid all but 7,000 dollars so he got lucky... He is now getting disability , that I fought for without a attorney, took the entire year and my savings to keep us going and I fought for a insurance check that he would not give me so much as a 10.. 00 when I asked for money... now he wants a divorce and wants me to pay him allimony,, and keep our 42 acre farm and me get nothing. So yes... you should divorce sell everything and split it down the midddle and find some happiness before you die,, I have spent 32 uyrs of doing without , while he has every gum and tool you could want and has classic cars that have 20,000 and thirty thousand eack in and I have had my teeth being pulled because I could not afford to fix them,, HE is a selfish person and I know GOd will forgive me... he has after all watched me endure this all this time. tnstepper

    Yes, a judge can order you to pay alimony from your income. At some point, perhaps when you go from disability to retirement social security, or when she reaches 63, your wife will be able to receive a check based upon your earnings. At that time you can have the alimony award modified. Her claim for alimony will go away if she remarries, although she will be able to draw from your social security. At least, this is my understanding.
