I moved out of my previous apartment and I now received my Itemized Security Deposit listing indicating that I owe my Landlord Rent for the month of October. This is my first time moving and I really had no clue of this since I had lived in this place for about 10 years. I asked the Landlord to provide me a copy of my agreement that states that I had to give a 30 Notice; they haven't been at all cooperative and they've told me that they can't give me a copy of my Rental Agreement and that it doesn't matter anyway because the Law states I must give a 30 Day Notice. Is this true? I really believe that they don't even have an agreement on file for me because since I've lived there it's changed owners about 10 times and so that's why I think they're so hesitant about providing me with a copy. By law they have to provide me with a copy, correct? If it doesn't state in my agreement that I must give a 30 Day Notice can I just move out?:confused:

Look up your state renting laws and see if the 30 day notice is really required by law.

If it is, you must pay, but if it is not, and your landlord cannot come up with a copy of an agreement you signed, I don't think you're legally required to pay.

You must give the landlord the same amount of notice as there are days between rent payments.176 This means that if you pay rent monthly, you must give the landlord written notice at least 30 days before you move. If you pay rent every week, you must give the landlord written notice at least seven days before you move.177 This is true even if the landlord has given you a 60-day notice to end the rental agreement and you want to leave sooner (see Landlord's notice to end a periodic tenancy.)177a


I looked up the law on their website and yes, you have to give 30 days notice if your rent period was 30 days, so I'm guessing you will have to pay. Sorry. :(
