    Levied bank account
    I am in the process of filing bankruptcy, but a creditor was granted a civil judgement against me and has gone through the steps of having a county sheriff walk into my bank and seize my bank account (in california). But there was $400 in the account, but only $120 was taken (along with a $100 legal processing fee by my bank). My atm card no longer works, but I've been able to pay bills on-line. My question: once I file for bankruptcy, will that levy be removed? Also, can I deposit money in that account and get access to it? And should open a bank account somewhere new or will that automatically be levied?

    Not sure why only $120 was taken if that's less than what you owed. But if you own more and you deposit more then they will freeze that too. And no, the bankruptcy will not get that back.

    If you open another account in the same bank it might be covered under the order.

    If you open an account in a different bank they might find it and attrach it as well.

    I don't know why they only took $120 either. Or why I can still bank on-line. From what I understand about bankruptcy, once I file there's an automatic stay and I should be able to use the account then. BUt I kind of don't want to, as my bank has not been very cooperative in giving me any information, even to tell me if I can deposit a check!
