    Marrying an Alien With Visit Visa
    My girlfriend is Romanian and we met 2 years ago while working in Kuwait. We have since left Kuwait and come back to the US. She is here on a Visit Visa at the moment and we want to get married. What are the requirements for us to marry? Do we still need to get a K-1 Visa? Thank you.

    If her visitor's visa is close to expiring, yes you should have her apply for a K-1. Even after you are married she does not automatically get a green card. It can take several months for the green card application based on marriage to be accepted.

    USCIS will review the file and during this time she must keep a legal status by either getting an extension on the visitor's visa, a K-1 visa or leaving the coutnry until it's processed.
