The Magna Carta influenced the development of the common law and the many constitutional documents such as the United States constitution and the Bill of Rights. The United States Supreme Court has traced our dependence on Magna Carta for our understanding of due process of law, trial by jury of one's peers, the importance of a speedy and unbiased trial, and protection against excessive bail or fines or cruel and unusual punishment. The 5Th amendment of the U.S constitution protects the governments' authority in legal procedure. Among these were the right to habeas corpus, a clause protecting the freedom of the church, and other clauses which spelled out the rules for due process of law.
The Magna Carta was the fundamental of the law. The framers of the United States constitution would ensure the rights that was already held provided in the Magna Carta. Also both were instigated due to a lack of government efficiency.
The United States Supreme court had understood why the Magna Carta came about the due process of law, trial of jury of one's peers, the importance of a speedy and unbiased trial and protection against excessive bail, fines, a or cruel and unlawful punishment. The difference is the Magna Carta is a charter of ancient liberties guaranteed by a king to his subjects; the constitution of the United States is a establishment of the government by and for “We the People.”
