    In the absence of a lease. You have a lease so it's different.

    You posted earlier that the lease prohibits others from moving in. So remember that you will need the landlord's permission to take on a new room-mate. And I suggest you make a written contract with that new person.

    I would def get their permission. Though I am not sure if this is a route that they would want to go. On paper my ex looks like he makes plenty of money to be able to do this on his own compared to me, However the problem is he can't keep it and really doesn't pay, myself or someone else is always covering his bills.
    My concern is that they can find some sort of loop whole that they can use to get me out.
    I know he isn't going to pay the rent that is do right away and I have no means to be able to pay this month because I wasn't planning on this craziness! So I am thinking then she would have grounds to evict us both for non payment and then maybe turn around and give him a new lease...
    I am prob over thinking everything but he is just not well right now and would go above and beyond with lies to do whatever it takes to screw me.
    I have plenty of grounds to put a restraining order on him, but I really don't want to do that. I just want this to be cut and dry.
    Is there anything you can think of that they could do to push me out? I know this seems so silly its just a home, but it is my home.. It is where I want to be and it is a great place to be...

    You keep asking the same question. Please don't start new threads over the same issue. Your threads have been merged. Please just respond to this thread.

    To summarize ONLY the landlord can evict a tenant. Since you are both on the lease the landlord would first have to give you a vacate notice. And, as long as the lease is in effect they can only evict for a breach of the lease. After sending a vacate notice, they have to go to court for an eviction order.

    If your landlord agrees, you can change the leaseholders, but they are under no obligation to agree. If he doesn't apy his share, you have to pay or risk eviction. You can then sue him for his share.
