    Not in NY where you need an Affidavit by an LPI or someone with similar credentials that the person could not be located. That involves Court records, Driver License searches, DMV searches, tax records and so forth.

    I think sufficient attempts to locate the father were not made. I see, if the father pushes, the adoption being overturned or, minimally a motion - if he cares, being filed to overturn the adoption. Someone knew where he is/was - and it appears the Child Support Unit wasn't asked if they had an address on him. If they didn't, they found one.

    I'm not sure how straight forward and legal the adoption was. Curious to see what my colleagues think.

    JudyKayTee: Only the police can do a Dmv search. When I stated grandfather, I meant the biological's father .I called him looking for his son.And he stated he had no information for him. Doing an online search for someone is more proof then 411. We also did a public announcements in the newspaper.

    The Newspaper ads, and the relative contacts, are probably enough to satisfy the court.

    But there is still the perplexing issue of why he all of a sudden showed up and agreed to pay support.

    I still find this shocking - in NY anyone with a PI license can run a DMV search. I haven't had a chance to look at your State. I am likewise surprised that the Court didn't either access DMV for you OR that the Court didn't recommend some other means of notification.

    I am not criticizing you. I am simply stating that the means of notification you used and which were accepted by the Court are NOT acceptable in NY. I also realize you are not in NY.

    I have no idea what "411" is.

    Pubic announcement in a newspaper IS sufficient in NY if it's by Court Order. I don't recall you mentioning that before.

    JudyKayTee: 411 is old school way for looking up people. The public announcement was court ordered. Our form for diligent search had web search as well as relatives .

    Also the court could have ordered the search, at least here in GA, almost all of the court clerks ( or at least on person in each office) have access to not only DMV but NCIC records also ( if they have a valid reason to look)

    But I do agree, and perhaps I missed it somewhere, has the bio father now been informed of the adoption. Now that he has come forward to appear in court.

    Has child support enforcement and the court that ordered child support **after*** the adoption, have they been notified by anyone of the adoption.

    Fr_Chuck : I don't have a way to contact the biological father. I will contact the child support office tomorrow. I thought the certified copy of the adoption was going to be in the mail today.
