Can my wife legally kick me out of home?
My wife of 10 years has just informed me that she wants a divorce so she can be with her new boyfriend. Currently we live in a rental home that she is buying on contract. It is in her name only. Last week she threatened to call the police if I didn't leave. I told her "go ahead I haven't done anything wrong". She never followed through on it. So my question is, can she just up and throw me out on the street legally if I haven't broken any law?

Can anyone give me tips on being homeless with a running car?
My wife wants to kick me out so she can move in her new boyfriend and I think I'm going to end up homeless within a month. I don't have enough money to get a place, or rent. All I forsee is living out of my car for least a month possibly two. How can take showers? How can I not be messed with by the cops?

Here's what you say in your other thread: "My wife wants to kick me out so she can move in her new boyfriend and I think I'm going to end up homeless within a month. I don't have enough money to get a place, or rent. All I forsee is living out of my car for least a month possibly two. How can take showers? How can I not be messed with by the cops?"
She has to evict you according to the law of your State UNLESS she gets a restraining order against you.
I don't understand why you are penniless and living in your car. Does she pay all the bills?
You need a divorce Attorney - now. You need to protect yourself.
Homeless people who live in cars sponge bathe at fast food restaurants and gas stations and take showers at truck stops which allow them to use the facilities.
Get an Attorney - now.

Really don't see how she can kick you out unless it is court ordered, if you are on title the court usually makes you sell the home and split the proceeds. Call an attorney if you don't have money they may appoint you one or keep trying to find one that will take payments good luck and God bless also say a prayer honestly they really really work

Call your county or township social services phone number and connect with a social worker or counselor. If that doesn't work for you, please tell us why it didn't. There are more options.

I don't think that she can kick you out for no reason, unless there is record of domestic violence. It's the house under your name? And be careful she doesn't find a excuse to call the police on you.

Your wife has to go through the official eviction process to get you out. This may take a month or more. This should give you time to get your affairs together so that you may find a place to live before you officially have to leave.

I had a great job, then she moved, I followed, no market here, been out of work for awhile, finally had to get a mediocre job, which leaves me next to nothing once I pay my car payments and gas/food.

She is on the renter's agreement, not me.

But you are still a tenant. She will still have to go through the eviction process.

She can not legally just kick you out, but to be honest, that does not help you if you come home one night and all your belongings on in the yard or in trash bags on the porch.
So she is suppose to give you a notice and evict you though the courts, if she does not and just locks you out, if you call the police they "MAY" force her to let you back in, but then they may not either, and you would have to sue her for illegal eviction, in which case you are still out sleeping in the car.
1. is there a friend you can sleep or shower at temp ?
2. there may be homeless shelters, many homeless people or families actually have cars
3, for a small price you can often shower at truck stops
4. many homeless don't shower but they wash off at gas station bathrooms
5. for a small price join a YMCA where you go in and can shower and do programs, get on internet and so on.
Talk to some body shops and or repair shops, around Atlanta most have people who "sleep" in the back in old vans or cars as "security"
Local truck stops or highway rest stops often allow sleeping in a car.
Is there a local camping area, my brother in law stayed in a tent for about a year.

You are incorrect. Pleae don't post "I think" answers on the legal boards.
She CAN evict him. Sounds bizarre but it's true.

There are two things here. You are a resident in a home that is in her name only. That means she can evict you if she follows proper process.
She can also file for divorce. As part of the divorce she may be able to force you to move out.
But legally she can't just kick you out.
