Breaking and entering a house
My son was gone but two men one armed with a bat and the other one armed with an unknown object entered my son's house during the night going from room to room and then barged into my other son's room demanding to know where my other son was at and then left the house. What legal action can they take? The cops said that it is up to the DA whether to issue a warrant. They did get a liscene number from the vehicle.

And no one called the police ? How do you know it was two men, and how do you know they had a bat? Of course its unlawful to enter a house without permission.

Issue a warrant for who? Do you know the men? If no one knows who the men were, how can the police do anything?

They report it to the police who will investigate. The police will present the case to the DA for prosecution if they find sufficient evidence to identify and capture the perps.

Hello m:
Where I live the cops would throw the perps in JAIL, and then let the DA make his decision... I don't know why your cops are such pu$$y's. I'd call the chief and ask him.

This is one of those "are we there yet?" situations. The authorities are working on it. Be patient.
I suspect that your son, the one who was not there, has a pretty good idea who these gentlemen are.

So why are they looking for brother ?
How did they get in, did they have a key, did someone give them permission to enter the house, Did they break a door down, break a glass in a window.
Where you in the house when it happened ?
How old are the "boys"

They live in a rent house while going to college and one son was out with the other roommate while the other was in his room asleep and yes the front door was unlocked. This all stems from a young lady friend. I live over two hours away and will make the trip Monday to go visit with the police dept to see where they are with the case. I feel that the police are lazy because they have not question the peeps yet. The bad thing about all of this is that my younger son that these two peeps were looking for sleeps with a pistol and is majoring in criminal law to become a game warden. This could,ve gotten out of hand real quick and he might have had to live with a bad situation for the rest of his life if he was in his bed when these two punks broke in. My son,s girlfriend identified one of the peeps by a pic on Facebook that I will present to the cops Monday. Every cop where I live at all said the same thing, if the boys had an idea who the peeps were ,they would go pick them up for questioning, I feel like this has not happen yet, I will let y'all know after my visit

I'm afraid that the DA won't do anything just like the police maybe they will since my sons girl friend can identified now

Umm "peeps" are little marshmellow chicks. I assume you mean perps.
Frankly, I'm having a real hard time understanding this. You seem to think you know why this happened. But haven't explained that. What are the "sleeps" they were looking for? What does your son wanting to be a Game Warden have anything to do with this?

Hello again, m:
If you're having trouble with CLERKS, you DON'T resolve it WITH the clerks. You take it up with their BOSS. That's the CHIEF. If you don't see him, you're whistling Dixie.
I, too, would be interested in the answers to Scotts question.

How so?
If I happen to have a postol under my pillow when a couple of guys break into my house armed with baseball bats, I wouldn't hesitate for a second. It's called self defense.

Of course why is the front door unlocked, and we still don't know why they are looking for this other person. And of course my opinion of sleeping with a loaded gun is that it shows a real lack of responsible behavior, most likely a girlfriend, or the younger brother is going to be the victim when he is startled one night

He use to date this girl that this boyfriend now is seeing and we do not know the reason as of yet why they broke or so called walked in. I visited with the police and they questioned the two men and old girlfriend and just about got a full confession and sent it to the DA. He has always wanted to go into some type of law forcement and is trying to get accepted into the game warden academy. I disagree with Chuck's comment on the lack of responsibility having a gun next to his bed. He is licenced to have the gun and that is why I mentioned about the game warden business and that is why he has a gun

So he is LEO wannabe and that's why he has a gun?
Please understand, I don't think he need an excuse to own a gun. But the fact that he hopes to be a game warden someday doesn't explain why he thinks he needs it now.

Yes, that was kind of strange. He wants to be a game warden, so keeps a pistol under his pillow. Game wardens don't carry guns in Ontario; they do however carry a lot of laws and regulations why someone is not licensed to shoot deer or moose out of season.
I have no idea why this thread has gone so long because we are all going around in circles and his dad doesn't really know what he talking about.
