Gang related graphiti on my child.
Would a court prove a parent unfit if the parent was drawing gang related things on the child? The other parent has a picture to prove it

    How old is the child,

What type of drawings, and with what

And while I think this is bad, I am not sure it makes them unfit, just stupid.

As Fr_Chuck asked, what type of "gang related" things and what were they being drawn with?

You state the other parent has a picture to "prove" it - do they have an actual picture of the child being drawn on, or just the child after the "thing" is already on the child?

The child is 2 years old. The picture was taken after the parent drew on the child. The child stated who drew on her. It is a symbol for the gang the parent is with.

What did the parent draw the symbol with?

You're going to have a hard time finding a judge to allow the testimony of a two-year-old saying "Mommy/Daddy drew on me." Parents tell their kids to lie in court all the time.

Is the other parent stupid? Absolutely. Are they unfit for putting a stupid symbol on a child? Not so much.

The symbol was drawn with pen. There are other drawings as well. The judge that is currently hearing the case is not so happy with the parent that is drawing on the child. There is other proof that this parent is involved with other illegal things as well.

No one can predict what a judge will do. So, if there is an ongoing court case, why bother to ask what the judge will do? Just let the case unfold. Present the evidence and see what the judge will do.
