    Ingrown toenail
    Since you are a nurse, I'm sure you know how an ingrown toenail is removed.. Tell me if this is right and if you think this is medical malpractice.
    My boyfriend had his ingrown toenail removed in a doctors office without the proper tools. The doctor was told by him that the toe was NOT frozen and that he COULD feel everything. The doctor proceeded.
    Anyhow, he propped his foot on the office trash can and stuck gauze without any anit-biotic ointment to his toe. He then wrapped it and left the office. (Keep in mind he tore the whole nail off.) He never gave him any pain meds until he said he was in way too much pain. And didn't give him any anti-biotics in case of infection.
    I know that sounds a little too messed up for me, but I was there for some of it and had to leave before the doctor started with the nail removal. But seeing my boyfriend go through all this was something I don't want to ever see again!

    If the procedure went as you have described it and your boyfriend can PROVE it, yes, it is medical malpractice. Your boyfriend can sue for monetary damages. Of course, that will involve another specialist testifying that the first Physician acted inappropriately and that additional treatment was needed due to the malpractice.

    What are his monetary damages?

    We have pictures but none of what the doctor did when he did it. But everything has been recorded since the day this was done. And now he not only still has trouble walking but, has a small marble sized lump forming on the top of the foot. He hasn't felt his leg from his shin to his toes. (He describes it as if he were walking on a fake leg.) Is there any chance of nerve damage from this? And it's hard to find a lawyer to take a case like this.

    You can't find an Attorney without medical reports from a treating Physician so you need to find a Physician to treat the current condition. Photos are meaningless.

    I have no idea why you are having difficulty finding an Attorney for a medical malpractice case. Contact your local Bar Association and ask for a referral.

    No, we can't find anyone. They say there is conflict or push us out the door or they just don't do medical malpractice. Well, we do have everything recorded on video too! And we had to go to the hospital several times and he ended up with infection so we went to his family doctor a few times too. He watched the blood pour out of his toe when the doctor took the nail off and then watched him wrap the dry gauze around his toe then wrap it with the dressing. What's the "local bar association"? Is that the lawyer referral? Because we called them and the lawyer they gave us didn't do medical malpractice.
