    If a tenant paid a deposit but didn't move in, does the deposit get returned?
    I am renting my house out. I had a couple sign a lease and give me a deposit. One week before they were to move in they backed out because one of them lost their job. I have found someone else to move in but that person is not moving in until July. Do I have to return the deposit to the original couple or do I keep it since they broke the lease and now the house will be empty for almost a month?

    You could return the deposit in good faith. You found a renter anyway, so why take money from someone who needs it.

    It isn't that simple. I was living in the house and had all of my stuff moved out so they could be in by the date they wanted. Now I either stay in an empty house or pay to stay in a hotel because I have a full week left of work before I move out of town and I still have to pay the mortgage on the house. I'm just trying to find out what my legal rights are.

    You are entitled to deduct from their deposit the rent from the time they would have moved in until the date that a new tenant moves in. If they were supposed to move in on June 1 and a new tenant is not moving in until July 1 then you can retain one month of rent but you must return the balance of the deposit to them.
