    What rights does he have and what can I do to prevent him from getting joint custody?
    My ex boyfriend and I split up recently, we have one daughter she'll be 2 in July and Im expecting our 2nd child in July. His name isn't on any of our first daughters paperwork classifying him as the father. He doesn't help support them, he doesn't come see her, or anything. We live 6 hours from each other and he refuses to drive to see his first child. The only way he has seen her is by me moving in with him and yet he kicks me out when we argue or he don't want me there. He's only bought her 5 outfits 3 pair of socks a small thing of baby wipes. The only money Ive received for her is $20 and that was when she was 15 months. Our 2nd chid has cysts on her left kidney and will need frequent doctor visits when she is born and again his name isn't on this child either. He says he is going to take me to court for joint custody. What rights does he have, what's the most he can receive and what can I do to prevent him from getting joint custody?

    If you receive any type of state assistance, you're going to be required to give the names of potential fathers for the child(ren). That way, they'll go after him for child support. Is there a reason you didn't list him on the first child's birth certificate and are planning on doing the same for the second child?

    The only way you can "prevent" him from receiving joint custody is by proving that he isn't a fit parent or may possibly be a danger to the child(ren).

    You stated that you live six hours apart - who moved, you or him?

    Him being on or not being on a birth certificate does not effect this at all, expect it would require him to prove paternity in his filings.

    Him living so far away will hurt with the joint custody, since normally the courts will want him to live in he same school district when the kids are old enough for school.

    On payment, is there a child support order in place, ( sounds like there is not) so he does not owe you any support and is not late unless you have a court order.

    He can and will get visits in his home, for weekends and even weeks during the summer and holidays unless you can prove he is a danger to the child.
