    Ex wife kicked out my daughter. What to do next?
    Hello Everyone,

    I'm here to get some advice about my situation.


    Background: My Ex and I were married back in 1992. Had two children. Divorced back in 1997 in California. We both have joint legal and joint physical custody of both children. I pay child support. She moved in 1998 to North Carolina. I joined the Army and was sent to S Korea in 1998. Returned to Georgia in 1999. We both remarried in 1999(she)/2000(I). My current wife, child and I visit my children every holiday, summer and extended weekends. In Sept 2008, my Ex filed for a modification of child support. I was working with Child Services to take care of this.

    Situation: In Dec 6, 2008, I received a phone call from my Ex stating that I had to come pick up my daughter that she wasn't allowed to stay there anymore. Found out that they got physical. I talked with my Ex to find out about what happened. All she told me was that she didn't want Child Services involved and that she wanted my daughter out of her house. I asked if it would be possible for her to meet up at least half way but she said she couldn't. I was prepared to hear this because this is what she tells me most of the time when I arrange to meet the kids. So I packed up my family to take the drive. It takes 8 hours to get there. Got there picked up my daughter. While waiting for my daughter to get her coat my Ex hands me a hand written statement saying that she was giving physical custody of my daughter to me, that she was to attend school in the area I live and that all medical decisions were up to me. Drove back. That Monday made arrangements for my daughter to start school also went to Child Services to notify them of the change. I was notified that she still wants the modification done.

    My daughter has been with us for a few months now and my Ex refuses to help with her in anyway. What can I do to insure that both parents are supporting my daughter?

    Go back to court.

    File a petition with the courts to modify custody.

    You can't force her to visit or call, but you can force her to pay her child support and official change the current custody order.

    Quite honestly I don't want her to visit or call or pay child support. I want to make sure we are no longer obliged to pay child support to her. My step daughter will be 17 In March 2010.
