The debt does not die just because the car was repod. Most likely the original holder of your debt has sold the debt to a new collection company and yes they can sue you. Follow this8384 as she helps you determine if the sol has run out.

    Hello k:

In general, the statute of limitations on filing a civil suit is 3 years... Even if you lived in a radical state, the longest SOL I've ever heard of is 6 years. So, no. They can't sue you.

I agree, you still owe the debt, but if you want them stop hassling you, follow the part of the FDCPA where it tells you how to tell them to STOP bothering you.

If they DO sue you, tell the judge when this happened, and the suit will be dismissed...

Not so sure on this. The sol only prevents them avenues of collecting on a judgement, does not stop them from sueing. Maybe Judy or this8384 will know more.

But they would have already been to court 14 years ago to do the repo, so are you sure there is not already a judgement in place

If SOL expires, the creditor cannot legally sue them for the money. However, I doubt they'd wait 14 years and then suddenly pop up with a lawsuit... something doesn't add up.

    Hello again, k:

There are a lot of bottom feeding collection agency's out there, who buy "uncollectible" accounts for pennies on the dollar and take their best shot at them. Some people go for the okee doak. Some don't.

As others have mentioned, you still owe the debt. Therefore, the agency can do anything within the law to collect EXCEPT sue. However, I told you how to stop them from even doing that.

this8384 thanks for the explanation, I thought the sol did not prevent a suit just the forced collection of the money.
