Hi I got charged like 4 years ago for theft under and I got the charges dropped and this summer I got caught stealin from superstore and just a week before my last court date I got caught again stealing again from LCBO liquir store... I just want to know if I am going to jail or what'd happen? Please help me

OOPS, nudder Canadian in trouble with theft. They seem to come out of the woodwork !

You got the charges dropped and went right out and did it again and then you tackle a government liquor store (LCBO). They are going to bury you guy, you don't steel liquor from an LCBO and get away lightly. They are going to throw the book at you mate.

Yeah sad thing is NOW I learned my lesson... will I get jail time?

Yes you will get jail time if it is your third offence. Probably Kingston.

It is very likely that you will get time, my guess about a year and then parole ( probation) for another two.

I really do doubt you'll get a year; but I am curious as to the outcome.

I am a fellow Canadian, who has been caught a few times in Alberta, and once in both Ontario and Saskatchewan (these all resulted in "being banned", telephone calls, police coming, fines, etc). Only once was I charged though (other than the very first time I was caught and charged, at which time I was a minor and went straight to the Alternative Measures Program). This latest charge did end me in court, but fortunately I was given another chance with the Alternative Measures Program (apparently here in Alberta, the adult and youth programs are treated completely separately). Next time I am caught, I'll be done for though, I am sure.

So much has to do with your attitude in court towards the authoritative figures; your presentation --wear clean, semi-business attire (not faded, ripped jeans and a shirt showing your stomach, or put on a tie if you're a guy); look alert, sincere, and like you are taking the matter very seriously; be prepared with your answers (have some specific ideas of meaningful community service work you can do that pertains to your circumstances... say for example, since you were caught at the LCBO, suggest putting in hours at MADD; and/or propose going to 12-step meetings (where chair-people can sign a sheet to verify your attendance) which will show you "are admitting you have a problem"); speak clearly and loud enough to sound like a person of substance, yet apologetic at the same time. AND DON'T BE LATE for any court appearances, or appointments with your PO. The point is to appear to the law like you've done some thinking and have ideas that would actually be more conducive than putting you in jail and wasting not only tax dollars, but also space in a cell. Imagine you are a judge, and think of creative ways to actually get the message across to an individual (ie. You) that shoplifting is simply not a possibility... then present several of those ideas to your PO, or at your hearing. And make them severe enough to be on par with going to jail. I honestly do wish you the best of luck. Keep us posted.

Why shouldn't he take it very seriously. He is in court because he is a repeat offender. I am Canadian too and, you know something, he is actually abusing my tax dollars by even being a repeat offender.

Your post sounds like a 'how to' beat a rap in court. I don't think it makes any difference at all how he dresses, how he approaches the judge, etc. The evidence will support itself.

Wow... well I was supposed to have about 3-6 months jail time and guess what I got? OK first of all I had court for it this morning.. I was VERY scared and I HAVE learned my lesson... I didn't have to act sorry or sincere because I trully was! I talked with my lawyer and she got me a disclosure so the charged WERE DROPPED! I have only 2 months community service.. and I'll probably have to write a letter of apology to the company which is noooo problem... well thank you all for your support! I really do appreciate it :)

I was hoping you would take my reply as lightly as it was offered. I am not pissed one way or another, jewel and sincerely hope you don't re offend. It really doesn't look good when a lot of Canadians write into AMHD (and that really does happen a lot !)asking for advice because they have committed theft. It is kind of embarrassing really.

I know I deserve a more harsher punishment and I would have accepted it if that's what I would have ended up with! I know I messed you more times then I should have gotten away with but hostly from my heart I have learned my lesson.. not only for myself but for my 2 little brothers who look up to me and told me the other day they want to be just like me one day... the second I heard that it made me open my eyes.. I know I'm still far from a good example but I am putting effort in trying to change...
