    I am Incarcerated and Found Out I Am Being Sued for Credit Card Debt
    My son is in jail in Maine and was served papers that he is being sued for a credit card debt. What can he do. He owns nothing.

    No he hasn't talked to anyone concerning his credit card debt. I believe all cards total 45000.00

    Hello daisy:

    The only thing he can do is write a letter to the attorney and tell him of his situation. Most attorney's aren't interested in pursuing something if they're not going to get paid... That may not stop them, however...

    If they get a judgment, it'll last 10 years. After his release, if they FIND him, they'll be able to seize his bank accounts and garnish his wages.. If they do get a judgment, your son can probably settle it for pennies on the dollar if he can raise some cash when he gets out.

    I'm assuming that he is the only one on the accounts, that is, there are no joint account holders. If there are, then the creditors will zero in on them. But if the debt is all in his name, all they can really do is try to get a judgment that will attach to him when he is released. If somehow, you or your son or maybe a willing attorney can inform the credit card company of his situation, it might help somewhat. Depending on the length of incarceration (more than 7 years), they might just drop the suit. Usually, creditors stop reporting bad debt after 7 years. Given the fact your son is where he is right now, there really isn't a whole lot creditors can do. Good luck to you!
