Parole violation
Can it be considered violating your parole if you get fired for drug suspicion?

It wasn't me it was my step-daughter. Her supervisor suspected her and a few other employees were doing drugs so they were fired, but the supervisor offered her to go get a drug test and if she was clean she could have her job back on the spot, but she refused to go have it done. I'm wondering since she is on parole, not probation, if that would be considered a violation of her parole.

What State? Is employment a condition of parole? Is she dug tested regularly?
Why did she refuse to take the test, instead choosing to be fired? Is she using?

The state is PA. I do believe she is to maintain a job while on parole. She hasn't been drug tested for a while as far as I know. I can only assume that the reason she didn't take the test was because she knew she'd test positive for drugs. I have suspicion that she is doing drugs but no actual proof. She is VERY good at making people believe her that she is doing real good and keeping herself straight, but she has always been a very good liar. She should have been an actress because she can be so convincing.

I haven't changed my mind. In terms of violations, probation or parole doesn't make any difference.
Getting fired is NOT a violation. Refusing to take a drug test from your employer is NOT a violation. She WILL be drug tested by her PO. If she's dirty, and she probably is, then she's going down the river...
Now, ordinarily ONE dirty drug test wouldn't violate anybody. But, losing one's job over it, might.

I agree with excon. I never had to take a drug test for my probation because it was for evading arrest. *wink wink I am bad* But parole cannot violate her for getting fired or for that reason, the drug test was not required by the parole and therefore is in no way a violation of her parole. It is a violation and possible revocation depending on her conditions and if she's violated before, if she goes in and the parole officer tests her and it isn't clean. As far as I know she will have anywhere from 7-30 days to find another job before she can get in trouble for not having one. Even then it is up to the discretion of her parole officer to violate her depending on her effort and attitude. Sad but true. For all I know she could have refused out of pure stubbornness, I have been known to do that a time or two when it came to my word being questioned by a person I had no respect for.

Okay, she was fired 2 weeks ago. What if she didn't report it to her PO? Doesn't she have to report all of that kind of info right away?

- but she is required to have employment. She no longer has employment. I'm sure the being hired was reported; therefore, the being fired part would have to be reported.
Isn't this a violation?
I realize the accusations have no substance but what about this issue?

Tell her to call them TODAY. Technically she can wait till next time she sees them, but they are going to be pissed and could violate her if she can't prove she was looking. If she has another job by the time she goes back in she just changes her info. It's always safer and more responsible to keep your PO up to date, they appreciate you being responsible.
