On probation then got a DUI in PA?
I'm on probation for paraphenelia. I used my Section 17 and got it expunged from my record. I'm still on probation for this, but it's a misdameaner/Sec.17 probation. A couple days ago I got a DUI and totalled my car. No one was hurt and there was no other vehicles involved. I blew a .2 something on the scene, a .14 and .099 at the station. The officers told me they were going to use the .099 for my benefit. What is going to happen to me?

    Hello un:

I don't know what a section 17 probation is, but it doesn't matter - you violated it. They'll probably wait till the DUI is taken care of, and then they'll violate you. You could do the time you were sentenced to originally...

Or, they could violate you first and let the DUI wait. There's no way to tell, and there's no way to tell how bad it'll be. I can tell you this. It gets LESS bad the better your lawyer is.

I whole heartedly agree with your answer Exy. Your second comment reminds me of a criminal attorney I once worked for. He explained that you're only as guilty as how much money you have (or don't have).

Yes, most likely it will violate your probation, the orgainal crime will not be explunged and you will have to revisit the punishment on it
