WANTED: someone who knows about law!
Okay, I really need to know how or even if my guardian could press charges against my baby's father? I was 15 years old at the time and he was 34. We now have a 15 month old daughter who he has totally bailed on and I cannot get him to do anything. I am 17 now and he is 36 I believe. He has other children, too. So I guess the main question is how would my guardian go about pressing charges, and what could my struggling family get out of this? Please tell me everything you know!!

    Hello chick:

He could go to jail for statutory rape, or he could get nailed for child support. I don't know if you think this is getting something, but that's all there is.

The guardian doesn't have to press charges. What is done is that the "rape" be reported, then the District Attorney (DA) takes over in prosecuting the rapist.

What can you get out of this? Satisfaction that the rapist goes to prison and that he must report as a sex offender for the rest of his life, as well as getting child support from him.

It doesn't matter that he bailed out... he never should have done this in the first place.

Yes, I am a nurse now, but I was a legal assistant for 15 years prior to becoming a nurse.

Best bet is to get him for child support. That way you get money from him. If you want to press any charges on him I believe you can do it yourself now, but I would just file for child support.

Yes do you want him in prison for years or do you want him paying child support,

Either way, you can file rape charges by merely reporting him yourself to the police.

For child support you can actually file this yourself also.
