Hello:

After more than 2 grueling years, our divorce is finally over. My ex-husband and I settled on 3/18/09. My lawyer had both of us sign the final settlement judgment the next week and mailed it to Sacramento's (CA) Family Court the first week of April. It has now been one month and the judge has not signed the final judgment yet. I contacted my lawyer this week who called the court clerk. The clerk informed us that the Judge has had the paperwork since April 7, 09 but has not signed it yet. My lawyer can't give me a date when it will be signed, as he said that it depends on the judge.

Does any one have an idea approximately how long it takes to sign a fianl judgment court order in California.

The reason I'm anxious to get this document is that I'm in the process of re-financing the house and I need it for the title documents.

No. It takes how long it takes. If your lawyer can't tell you, no one here can either.

Sacramento is usually faster at processing judgments than some counties (like mine). I think the best counties at getting them through fast are the smaller ones, like Yolo, where you get them in about 3 or 4 weeks. I think the last time I sent one to Sac it is was about 6-8 weeks before it came back, which I thought was great. In my county it has been running about 8 weeks, but for a while it was closer to 12. I had one once come back in about 6 weeks and I thought that was truly amazing. But if you have only been waiting 4 weeks, that's no big deal and very common. I'd start looking for for the judgment to come back in the next 30 days.

Until the judge goes on vacation and everything gets backlogged and/or lost (happened to my fiancée... )

They've go something like 5 or 6 family law judges up there and they just pass the files to whomever is available. Frankly, they're fairly well-funded in that county and I don't think the judges there are nearly as busy as they are in neighboring counties so they get to the judgments pretty fast, in my experience.

You're welcome. You sound like my clients, so just hang in there and hope the judgment doesn't get kicked back for some minor defect. That happens all the time I'm sorry to say--in my county you wouldn't believe how picky they are.
