That is not true, especially if you are single. While your tax liability will probably be rather low, you STILL have the legal obligation to file an income tax return for 2008.

If you email me at [email protected] with the specifics (income earned, federal and state income taxes withheld, home country), I can do an estimate and quote you a fee to prepare your return.

I am Not Single and I am married - Can u Tell me when is the last Date to File now - I know deadline (15th April ) is gone..

Problem Is : I have Submitted my Document on 10 th April only to of the tax people – They Said – they can't fill tax for me since they already loaded with work – so they said they fill for tax Extension – Then I sent all my Document through mail – after seeing my Document ,they replied me that, we no need to file for Extension Since your Income is Low for this year – so I kept quit – But after few days again I got a mail that they need some more documents from me – I don’t have idea what they going. … But Actual Problem is before I sending the remaining documents they closed their office for 15 days - I don’t whether they have processed my file or not .
If I sent my documents to you for tax filing, after 15 days if that company ask to pay service charge for tax filling means what will I Do … … suggest me … what can I do?

    Bendctdesk:
You came to the U.S. in August 2008 so you did not complete substantial presence test in 2008. So you can either file nonresident tax return or file joint return as residents after you meet SPT in 2009. Read Your U.S. Tax Return: Substantial Presence Test

In both the cases, you must file. For nonresident return the filing requirement is $3500 and for resident return you may not have any taxable income, but you must still file. In this case you must report your worldwide income for 2008. Read: Your U.S. Tax Return: U.S. Citizen or Resident with Foreign Income

    BendCtDesk:

If you have a refund (which is most likely), then the 15 April 2009 filing deadline is meaningless, because any penalty or interest charged for filing late is based on the amount of taxes owed.

If you are due a refund, you owe NO taxes; hence, no penalties nor interest.

The actual deadline for filing your 2008 tax return is 15 April 2012, because you forfeit your refund if you file after this date.

I suspect your tax consultants took off two weeks to recover from the "100 days of hell" (a phrase popular among tax preparers to denote the heavy-work, higstress tax season of 5 January - 15 April), but they will eventually finish your return for you.
