Do I have to file 1042NR-ez or D400 or be clear?
    Hello everyone,

I am a F1 graduate student in North Carolina from China. I came here on 2007 and stay in the same school until now. I am not married.

I had an on campus job in 2008 from January and August.

Now I received a 1042-S and W2. The gross income in 1042-S is less than 2500$ and the amount in W2 is less than 300$.

I read from the 'foreign student issues' that 'All F and J Visa holders must file a Form 1040NR or a Form 1040NR-EZ when their U.S. source income is above $3500. '

I asked the IRS people with e-mail for my situation but they were asking me to read the instructions myself.

I am getting confused for what should I do next:

    1. Do I have to file 1042NR-EZ or 1040NR ?

    2. Do I have to file D400 for North Carolina State Tax ?

    3. I think I have to file 8843 since it is mandatory, is that the case?

    Any idea is well appreciated,

    Thanks,

If your income in 2008 is less than $3500, you are not required to file tax return. You should file to get the refund if any income tax was withheld.
Also, for state filing requirements check at the website.
Even if you are not required to file tax return, you must file Form 8843.

    Thanks a lot !

So I still should file 1042nr-ez in a normal way, but the purpose is for tax refund , not return?
I am a little confused about the difference between them.
