    Check Fraud
    Hello,

    In 2006 and 2007 my ex girlfriend wrote about $20,000 in fraudalant checks of mine. She was supposed to get back on her feet an d pay me back. It has been 2 years and she hasn't made any effort. Can I still press charges? And will the checks be covered under the fdic?

    I think you can still press charges - contact the police. If I understand you correctly, this so-called GF stole $20K from you, by using your personal checks and forging your name on them, is that correct? Did these checks all clear so your account was debitted the $20K? Also, why do you ask about FDIC? FDIC insures depositor's accounts against the bank going bankrupt, not against fraud by your GF.

    Yes, the money was debited from the account. Ive called the police and they are getting back to me in 3 to 5 days. I called the bank and they said they only investigate bank fraud that has happened in the last 3 months. How will restitution be paid?

    You have your GF charged with theft, and offer to drop charges if she pays you back. Otherwise she goes to jail, and you sue her for the $20K.

    Hello J:

    Had you notified the bank right away, THEY would have covered your losses. Had you called the cops right away, THEY would have gone after her... Had you sued her right away, YOU would have won a judgment.

    But, because you waited, there's no guarantee that ANY of those actions will be carried out.

    The cops and the civil judge'll think there's something else going on here, after such a long period. I think there is too - like maybe you just broke up and want your gifts back... I don't know. Why DID you wait?

    The place I work for had an employee steal money. Instead of turning her in, the owner's agreed to let her pay it back and if she didn't they would call the cops.

    Found out after she failed to pay anything that the cops considered the deal a contract since the company agreed to let her pay it back. To get restitution they would have to sue and get a garnishment.

    You beat me to it - plus this is boyfriend/girlfriend and I can see the fact that they continued to cohabitate - if they did - to indicate that he forgave the theft.

    This would be a very difficult case because of the time line and relationship.
