My probation officer committed purjery against me!-Indianapolis
The main points:
I'm on probation for possession of marijuana
I hadn't started my drug classes.
I forgot to call the random drug testing hot line one day.
I have good reasons for both issues, but look how this probation officer took advantage of the situation and committed perjury.
What should I do?
Here in Indianapolis we have to call a drug testing hot line mon.-fri. to see if we have a random drug test.
I forgot to call on Feb.3,2009.
I didn't call on Jan. 28,2009 because she ordered me to take one so I had no need to call.
So here's how it went.
I went to see her for an appointment on Feb. 17 2009 she was a real b&#%h as usual. She punched my gallery number in her computer and said" You didn't call the drug line on Jan.28 and Feb.3 and you had to test both times."
I responded" I did test on Jan. 28th because you ordered me to test so that's why I didn't call, I new I had to test so why call."
She punched some keys on her computer and said " Oh you did test well, you missed a random drug screen on Feb.3rd".( she was lying before she even checked to see if I tested or not on both dates )
I said "That's impossible. I forgot to call because my job called me back after a month and a half lay-off on Feb.2nd. I usually call the hotline at night so if I have to test the next day I can get a babysitter. But since it was my first day back at work and I didn't sleep at all the night before work I was exhausted and I fell asleep before my girlfriend got home from work at 11p.m. At that time her cell phone was the only phone we had. I didnt call during the daytime because my routine is to call at night so it slipped my mind."
She said" Well why haven't you started you drug classes.
I respond " I told you I can't afford to go to that location because it costs $300 a month and the location right downstairs only costs $160 a month a had a choice in the beginning and I choose by geographical location, I was not told the price I thought they all charged the same.
She said " We don't have time to see how much each location charges. I'm setting an administrative hearing for you not starting your drug treatment.
During the treatment hearing with me, her, and her supervisor I was told all the drug treatment centers work on a sliding scale based on income. ( she deliberately withheld that information from me.)
As the hearing went on she brought up the same lie about me missing a random drug screen. I told the administrator she was lying. I then said "I was told that when you fail to take a drug screen the automated drug line tells you that you missed one the next day you call". They both said that's not true. So I said" show me some evidence that I missed a random drug screen. He told her to punch my gallery number in. I thought she was going to punch it in a computer, she gets up and takes four steps toward the phone and turns around comes back and sits down without even attempting. I said" what are you doing aren't you going to punch in my gallery number?" She stayed silent and looked at him.
They had no evidence and I know if someone misses a random test the lab sends that information to the probation officer so, I couldn't have missed or she being the bi%&h she is would have had that information from them right there to throw in my face.
The supervisor then said if I didn't sigh saying I missed he would have me arrested and violated, I signed because of the threat.
The papers were sent to the judge saying I failed to take a random drug screen which is Perjury! Here in Indianapolis that's a class D felony.
What can I do, usually a person could go to her supervisor but he was in on it. Should I go to his supervisor?
I want to go to his supervisor but I was told that they might lock me up for complaining. Can they do that?
What route would you take? Remember it can be proved that I didn't fail to take a random drug screen because the lab would have those records.
Should I go to their supervisor or should I go straight to the judge who strikes my as a very honest man?

What do you do
You start your drug classes, you call in every day, no matter what, use a friends phone if you have to.
And you forget this if you don't want to be revolked for a dozen other things they can come up with if they really do.
You don't follow the rules and get pissed when they come down on you. Please give me a break.
I will be blunt, you are the type of person they love, they will mess with you as much as they can because they can.
And remember when and if you did cause this person a problem, you will be back on probation with their best friend or person at the desk next to them that will be doing nothing but looking for one word, one minute late to revolk you

I have started my drug classes now that I know they work on a sliding scale based on income( she deliberately withheld that info from me), I was trying to get transferred to a more affordable location I was not just refusing, and I do call every night because I got my own cell phone to make sure.
The point I'm making is she and he knowingly and willingly committed perjury (class d felony)for their own entertainment. They should be arrested, fired, and put on felony probation. That's the point I'm making they are liers. Just because I make a mistake why should they use that as an excuse to commit a class D felony. That's their mistake just like I'm paying for my mistake shouldn't they pay for theirs.

Then retain an Attorney and go after them. If you can't afford to do that be aware that "they" are out to get out and make sure you meet every condition of your probation.
If you are sick and tired of the whole reporting/classes "thing," then go back to Court and ask to serve time in jail instead of probation.

Chuck, Judy and Excon have given you the "skinny" on this situation. I will add that it is up to you to call in regardless of the reason. This is part of your probation - to call in. There is no excuse except you are dead that is acceptable.
And the part about them lying. I don't think so. They deal with probationers all day long and don't accept their "excuses" for not calling in as well.
And as far as her "deliberately keeping" that information from you about cost - she could care less about what it costs the probationer - it's not her job to hold your hand. It's your job to find out on your own.
As Chuck pointed out to you - you will be on their "lets mess with this one" list and will be happy to catch you for the least thing in the future.
And yes, it's them against you. Tag, you're it.

She and he, willfully committed a CLASS D FELONY for their own entertainment. They said a failed to take a random drug screen. (PURJERY) And then said if I didn't sign he would have me arrested.
Now, my question was should I go to the head of the probation dept. Or should I go straight to the judge?

Actually you're the one missing the point. In the first place, perjury is only a felony if it's done under oath. Just plain lying ain't a crime, and they lie all the time.
There's really no place you can go to complain about your PO, unless you want MORE trouble... I know you have this sense of justice and fairness, and you feel you should be treated justly... But, that just isn't how it works. They have the power. They'll use it, too, and it might not be just or fair.

Yes, first even if they did, someone has to care, and the dept would cover it up and make it go away most likely. And before it ever happened, you would be in jail with all sorts of claims of things you did wrong, so when it came time for court, your word on this would have no value.
Sorry but trying to fight against the PO is a no win thing on a issue like this,
Fair, just, of course not, but the system is not. It is made to try and send you back,

You can't go straight to a judge, he merely rules on motions on cases he is hearing, he does not investigate anything.
The head PO, yep just have your toothebush and soap on a rope packed when you do go complain,
We are trying to tell you the real facts of life from both sdies, the person who was a PO before and a person who was supervised before.
They just have to pick up a phone and you get your house and car searched every few days, they go to your work place on a regular basis till your boss gets tired of it.
We are telling you real life, not TV CSI court TV.

We ARE getting it straight. You aren't.
Before you storm into the Judge's chambers - and very promptly get arrested all over again - I'd learn how to spell perjury.

I understand. I will take it. I have 9 more months to go and I'm going to leave this state and go back to Los Angeles where I was born and raised, and where I can use marijuana legally.

And just so you know I'm not a she I'm a man with two children.
And last, I would not storm in the court demanding to talk to the judge I would write him a letter.
All I wanted was some advice on whether I should go to the probation dept. Or if I should go to the judge. Of course by writing a letter I don't want to see a courtroom unless I have to. But instead of advice on the two options I got ragged on. I guess some people are very bored.
But thanks for the advice for those who made decent replies.

Do you have a medical marijuana card? If not then you can't legal use it in ca either,maybe there less strict there but it's still illegal w. out a medical card.While your on probation they have you stuck.Maybe speak to a lawyer and see if you can end probation early or transfer it to a different state. It suxs but you got follow every rule and deal with there crap until the probation is over. Good luck.

It's easy to get a card. $150 gets you a prescription.

Since when is asking for advice in a matter whining? If that's the case everyone in this section is whining. Whining that the op isn't listening, whining that things aren't right with the law etc... What Judy meant was we all gave you good advice about what to expect from the Probation Department when you are insisting that they committed perjury.
What she also meant was that you keep going on and on about them supposedly lying. Get over it. You are the one who is in the wrong by not calling in as you "forgot". As I said there is no acceptable excuse for not calling.
Usually males will listen to what we have to say here and figure out that we all somehow know what we're talking about from either personal experience or personal knowledge of the law and how it works.
Fair on their part? Maybe not. But legally correct? You better believe it. Who says the law has to be fair? You are the one on probation, not them.
As Judy so aptly pointed out earlier. If you don't like the rules of probation, just ask the Judge if you could spend the rest of your time in jail. Some people just cannot do probation as they can't obey any rules. A client of an attorney I worked for did have her probation revoked as she could not obey the rules and decided to go back to jail instead because when she did get out she could do everything she wanted with no drug testing, etc cramping her lifestyle. She traded 3 years probation for one year in the county jail.
