    If the social security check is deposted in your account along with your other funds, yes, because they are garnishing your back account, not one specific payment. If you don't want this to happen, then have your cheque sent to you instead of being deposited in the bank, and if you have other automatic deposits have them changed as well.

    Social security can not be garnished in most circumstances. Federal taxes, child support, and alimony are exceptions. But if mingled with other funds, you would have to prove it was your social security they took. As Tickle said, keep them separate. That will make it easier for you to establish the source of the money.

    Once you have deposited your benefit into a bank account, it would not be considered garnishment of your Social Security. A creditor would have to have a court ordered judgement against you AND then levy your bank account to take any of your money. That is a lot of legal work that most creditors will not do.

    As noted above there has to be a
    Judgement from the court and from that comes the "bank levy" but unless you owe the government some money like student loans, taxes or if you owe back child support your social security can not be touched.But it will up to you to prove that the money is exempt.
