Hi, I hope someone can help me...

I wrote 3 bad checks on my husbands account totalling 1700.00. I put them through the bank machine and cashed them. I have never been in trouble in my life but after doing this I realize I have a gambling problem and am very scared my husband doesn't know yet but I am taking steps to correct my addition. What could happen to me I wrote the checks to him on an account I knew was closed. Im very scared as I did this once before 2 years ago in a joint checking account we had and my husband fixed it for me. I know this is my own fault and I feel like a complete idiot as I know better then to do something stupid like this. I live in Ontario Canada and have never been in trouble before in my life. Legally what could happen to me?

My advice ? First tell your husband what you did. The sooner the better. And second go for proper anti-gambling consult. If you don't do both it is you who could cause a split-up between you and your husband, and get a date with the court system.

Go tell your hsuband, he will know when the bank asks for the money back.
If you and husband go into bank and pay them, or work out a fair plan to repay the money, nothing legally may happen ( up to the bank)
They could charge you with a felony and you still pay it all back, plus fine, and most likely probation.

Either way he will find out, better from you than from a police officer at your door coming to arrest you.

As far as telling my husband I have no problems doing that but he is a truck driver and right now he is in Florida and will be back Wednesday but since I have never been charged with anything in my life and being this is my first offence what could happen is it up to my husband to charge me or the bank beings the checks were written to him and I had his bank card? I've already made and appointment for counseling I go the 17th and I've been to see my doctor as well

Making an appointment for counseling is not going to do anything legally. I think you'll just have debt with huge interest with the bank. If your husband does not charge you with theft under 5000, you'll probably be fine. Was it a joint account?

I'm no expert so someone please verify.

If the Bank charges you why and how aren't going to matter. You need to head this off NOW - he's out of Town. Call him.

This is not correct. IF the OP is charged the circumstances of the theft - the how/why - will have nothing to do with the charge but CAN play into the sentence. She is repentant, she has acknowledged she has a problem, she is working to solve it.

So basically what your saying is working to solve my problem will help the out come of any charges? But what I'm asking is is it up to the bank to charge me or my husband?

If the Bank is not "out" any money, it will have no reason to press charges. I would repay ALL of the money immediately. If the Bank HAS notified the Police or if the person who cashed the checks HAS notified the Police, it's too late to try to head this off. I don't see how your husband, who appears to not have any part in this, can be charged by anyone, in any fashion.

Certainly, working on the problem, being "sorry," will go a long way when sentencing is involved.

But you aren't going to get to the sentencing part until and unless you find out if charges are going to be filed. So confess and take care of this before the bank does.

Thanks so much for everyone who helped me out with my mistake here. Everythings going well with my husband, he sorted things out with the bank and I started gambling counseling last week!! :)
