Taking 5 years for a divore?
My mother's fiancé filed for divorce from his wife over 4 years ago, it will be 5 years in February. I heard that in the state of PA the longest a divorce can be contested is 2 years, but this woman is finding every legal loop hole to have hearings continued over and over. She's posting right on her myspace page that she will never let this divorce happen and she's basically admitting to making up bogus reasons for a continuance and I feel like nothing is being done about it.

My main concern is that on her myspace page she is posting information about myself and my husband, who have nothing to do with the divorce and have never seen this woman a day in our lives, and she's lying and making up all kinds of horrible things about us and it's threatening our jobs and reputation in the area. We have a one year old and another due in less than 4 weeks and she's finding out information about us that she should have no way of knowing. I feel like she must be spying on us or stalking us to know this stuff and I'd like to press charges. What charges can I file and is there a way to do it for free or very cheaply because I hate to put money into a stupid charge like this but this woman needs to be stopped. She's making a mockery of the court and the judge's orders to stop posting things about our family on her myspace page and every time a new hearing is scheduled where we can present the judge with the new things she's been posting to show she's disobeying his orders she makes up some stupid reason she can't go and they get a continuance and then it takes months to get another one scheduled! She's already had it continued three times!

    Please help!

Retain an Attorney if you haven't already. Prove that what she is posting has caused you financial harm. Internet is sort of a big free for all but there are Attorneys out there who are waiting to find postings that harm reputation so they can be instrumental in some new laws.

If she wants to follow you around, you really can't stop her; you CAN stop her if she's harassing you.

As far as the divorce - only the parties to the divorce know what's going on and why. I'm in NY but five or six years is not unusual here. People make motions, get adjournments, argue over the cat's litter box.

Agree with Judy; five years isn't that long. And having it continued 3 times isn't that out of the ordinary, either.

The woman enjoys seeing your mother's fiancé miserable and she'll continue to drag this out as long as she can. As soon as they have an agreement drafted, she's going to "change" her mind and they'll have to start all over again. She doesn't want the divorce and clearly, she's not going to let him have it. Maybe someday she'll grow up and leave him to his own life.

As for her talking about you, the only thing to worry about is if it's actually causing you financial harm. If it is, then I would do as Judy suggested but you're going to need proof.
