    How do I get a person out of my home?
    My daughters boyfriend moved to New York from Florida. He was a nice guy when he moved in a year ago to my house I own. Now I want him to move out because he nearly hit my daughter. Back in August I called the police, I told him to move out. He was supposed to stay with my family until he can get on his feet. He has had 6 jobs during the last year & he was fired from the all. He will never get on his feet because he thinks he can do no wrong. He is 24 years old, my daughter is 17 1/2. He has never paid a penny toward rent, or food. I told him again today to move out & he said I have to evict him by giving him thirty days notice. I told him that I already told him to move out in August. Today my daughter accused him of taking her necklace which is missing. He knocked over a piece of furniture which had glass and ashtrays on it which were thrown on the floor. There was water and broken glass all over the floor. This guy is a user and needs to be out. He also said back in August he would burn my house down if he could not get his stuff. He came back to get his stuff and didn't leave because him & my daughter made up. How can I get him out?

    This means that she was 16 1/2 and he 23 when he moved in? And you thought he was a "nice guy". A 23 yr old having a 16 yr old as a girlfriend is hardly a nice guy.

    Do you think they are having sexual relations? If so, he may be guilty of statutory rape. The Age of consent in FL is 18, but an exemption exists for someone under 24, so its close.

    So this is what I would do. You need to give him a written 30 days notice to start the eviction process. But you might hint that if he doesn't move out immediately you will prosecute him for statutory rape.

    Otherwise, you wait the 30 days, and if he hasn't vacated, you go to housing court for an eviction order.
