    Child support after 12 yrs. In Tx.
    I have a question about child support ( Texas ). I had a one night stand twelve years ago, I learned about the pregnancy, and went up to the hospital and was asked to leave. I was told by the mother that I was not the father, and to get on with my life. Neither of us were married at the time. We have both since been married, me with two children. She has recently gotten a divorce. I just received a summons for a paternity test. I have an appointment with an attorney. My question is... can she sue me for back child support if the child turns out to be mine?

    Most likely not, especially if you can prove you tried to do the right thing and were told its not your child. But if it is your child , then you will probably need to start paying support.

    Another issue your attorney should be checking is whether someone else took on the responsibility of legal parent. If that happened it may let you off the hook even if you are the bio fasther.

    Your Attorney is going to have to look at this one - my research indicates that in some instances when the father was aware of the possibility he was the father and did not ask for DNA testing the support goes back to birth; in other instances it's two or three years; in others it's to the date the Petition was filed.

    I will be very interested in what your Attorney has to say - I hope you'll come back and let us know.
