    I this considered crimal trespassing?
    My husband was on my property and I scratched his car with a butterknife. Can this be considered criminal trespassing?

    Did you ever tell him - or is there a Court order - that he CAN'T be on your property?

    And you can't damage other people's property for trespassing, but I'm sure you already know that. Would appear at the moment, depending on the scratch, that you have committed the criminal act.

    Criminal trespassing is entering private property without permission. Damaging someone else's property is vandalism. So you committed vandalism in damaging his car. Whether he trespassed depends on the circumstances of why he was there.

    Actually Scott will do a correct there, that may be the terms for those words in your state, but each state law are different, for example in GA vandlaism is only done in a cemetery, it is not damage to anything else.

    Damage or theft under a certain value also falls under criminal tresspass, just the way GA law is written, So if the damage was under 500 dollars, yes that would be criminal tresspass in Georgia.

    Names of crimes vary by state.

    Wouldn't the property (car) be considered hers since they are married and the property that he was on be considered his?

    I don't know who holds title to the property and car - would be interesting to find out.

    It sounds like they are separated, "MY property" "his car"
    Either that or they need some seroiius marriage counseling.
