    I live in New Jersey, I was visiting a friend in upstate NY. Once I got off the exit in Utica NY; I didn't see a car standing still in the middle of the RD. There was no lights. My Car Tapped the back of there's. We both have the same make Car. There was no damage to my car, and none to there's. I gave them my info. I guess because I got scared. Yet, there was no police report or anything. We shook hands and left. There car was from Pennsylvania. Yet, I just received a call from there insurance company. I'm not sure what to do, or what will happen now? Does anyone know what I should do. I don't want my insurance to know, I cannot afford a increase in payment. Any good legal help?

    Their insurance may try to scare you but tell them to go fly a kite. No cops to state who was at fault, so no-fault.

    Of course they can sue you, but so can any tom **** or harry on the street.

    Don't sweat it. Kindly but firmly tell the insurance company that it was not your fault, that the ins info was traded in good faith and that there were no damages to either car.

    Turn it around on the guy. Ask them why they are calling you since you and their client agreed together that there were no damages.

    I'm really appreciative about your post. You're my second opinion. You and my boyfriend are totally right. I will do just that tomorrow. I will keep you posted on this subject. Again, thank you for your help.

    I will agree, first always call the police, yes I know it will cause you a ticket maybe and all of that, but it can also cost you a lot more in the long run.

    Hopefully this person is not claiming all sorts of medical problems or all sort of car damage now, But all the insurance company can do is sue you, if they actually sue you, best to get your insurance invovled, since then your insurance company lawyers will fight with thiers.

    And I guess what did their insurance company want, a statement of what happened, a check for 20,000 dollars, just to see ifyou were OK and not going to sue them? It would help a lot if we knew what the insurance company called you about,

    In general never admit fault, don't give a statement to the other peoples attoreny or insurance company

    If there is a reason to "trade Info" there is a reason to call the police, If no reason to trade info, you shake hands say you are sorry and drive away making sure they don't get your tag number and try to report you for leaving the scene.
