    Qualified Doemestic Relations Order QDRO
    My spouse ex has file a Qdro against his retirement. Does anyone know if that would
    Affect my retirement also ?

    "A “qualified domestic relations order" is an order that needs to be included in a divorce agreement when dealing with pension funds. The QDRO establishes your soon-to-be-ex-spouse's legal right to receive a designated percentage of your qualified plan account balance or benefit payments." See: What Is A QDRO?
    The QDRO should be between your spouse's ex and your spouse, only; and have no bearing on retirement that you own in your account(s).

My husband wants a divorce. He will need to QDRO part of his 401K to me to buy me out of our house. I will need that money to get my own place. Who has to pay the early withdrawal penalties; him or me? He says there is no penalty involved for either side. Is this true? Barbara
