My 86 year old mother lives in a government subsidised apartment in Arkansas and has 6 months left on a 12 month lease. Due to her health, we are putting a trailer on our farm for her. She told the manager that she planned on moving at the end of January. Due to unexpected problems, it won't be ready until the first of Feb. The manager told her she has to move by the end of January, even though she has never been late with her rent. She also was told that she'd lose her deposit because she broke the lease and that she had to leave a week before her rent was up so they could prepare the apartment for another tenet. Can they legally make her move before the end of the lease?

Thank you for your reply. If they do decide to go through with a legal eviction, maybe the month will be up before the paperwork is done.

What your mum should have done was not give notice to move and there wouldn't be a problem

No they can not make her move till the last day her rent is paid up though,

The problem is that she gave notice.

I know she shouldn't have said anytthing until the time was firm. All I'm trying to do now is "damage control". She didn't give written notice, just mentioned to the manager that she was moving. Guess there really isn't much difference.

First she is breaking the lease so she's lucky they don't hold her to the whole lease. Second, they were relying on her notice tofind a replacement tenant. Can't she move in with you for a couple of weeks?

I'm a bit confused... as far as I can tell, there's only one night between the end of January and February 1st. So what exactly is the issue here?
