    Collection Agency Hunting me!
    I'm in Toronto Ontario Canada

    During 2006, I fell behind on some of credit card payments because I had to pay for tuition. I didn't want to take a $5000 loan for school so I sacrificed my credit card. June 2006 the credit card company sent me to a collection agency, that has been aggressively calling and threatening me to pay the amount, just over $2000 Canadian.

    My questions:

    1. What is the statute of limitations in Ontario Canada ( they date after, they no longer have the legality to collect)
    2. I have never formally ( written correspondence) confirmed I owe the money, however during one of their many phone calls I may have hinted I owe this money? Does this increase or re-start the statute of limitations in Ontario?

    You hinted you owed the money?

    Anyway - don't know about Canada but it appears that the last activity on this card was in 2006 so they are probably well within the Statute. When you opened the card means nothing - it's the last activity date that starts the Statute.

    I would suspect now that you are in their sights you should be prepared to pay or defend (although I don't know what your defense could be).
